Registered Keepers Liability

Registered Keeper Liability:

1a) the law requires that the Driver and Vehicle Licensing Authority are kept up to date and informed regarding the identity of a vehicle’s current keeper.

1b) before we commence with enforcement for unpaid charges our collections department will check with the DVLA to see who the registered keeper of the vehicle was at the time of the offence.

1c) Failure to update a vehicles registered keeper’s details including: a change of ownership or a change of address etc. could lead to a criminal prosecution and a potential fine not exceeding £5000.

Owner Liability:

2a) if you sold the vehicle and failed to complete the relevant part of the vehicle registration document (‘log book’) you may receive parking charges issued against the vehicle arising out of actions from the new owner.

2b) you will have to produce evidence to show the date upon which you sold the vehicle. This may be an invoice or receipt. We will also require a copy of your insurance policy setting out when you transferred cover from that vehicle.

2c) this also applies if you bought the vehicle after the parking charges were issued against the vehicle.

2d) with leased or company vehicles the owner may or may not be the registered keeper.

2e) the owner will be pursued if the registered keeper fails to pay the charge.

Driver Liability:

3a) the driver is responsibility for the charges issued against the vehicle.  If “you” the registered keeper were not the driver at the time of the offence then you must provide the drivers full name and contact details including a copy of your and their motor insurance polices to prove they had authority to use your vehicle at the time of the offence.

3b) if you cannot provide the drivers details “you” the registered keeper will be held liable for the charges issued against the vehicle.

3c) If the vehicle had been taken without your consent or was stolen please quote the police crime reference or insurance claim number.

Representations:

4a) you can only make representations on one of the grounds listed below. Please indicate which grounds you wish to make representations and provide all evidence supporting your case. Please note: representations will only be considered on the points listed below and if submitted within 14 days from the ticket’s issue date.

a1) the alleged parking contravention did not occur.
a2) I was not the registered keeper/owner of the vehicle at the time of the parking contravention.
a3) I was not the hirer at the time of the contravention/I was the hirer but had not signed a statement of liability.
A4) we are a hire company and the hirer had signed a statement accepting liability.
A5) the vehicle was being kept by a trader at the time of the contravention.
A6) the vehicle was being used without my consent at the time of the contravention.

4b) upon receiving and processing your representations we will either write to you or send you an email with our decision. If we do not accept your representations then you may appeal against our decision on any of the grounds listed below.
